Artwell Guide's Privacy Policy

Artwell Guide ("Artwell" "we," "us," or "our") takes the collection or submission of your information very seriously.  This policy regarding our privacy practices (the "Privacy Policy") describes how we treat the information we collect when you visit and use the site Artwell, located at www.artwellguide.com.  When you use the Services, you agree that your information may be collected, stored, shared and used as described in this Privacy Policy and in our Terms of Use.  Please read this Privacy Policy carefully.

So what information do we collect?

For starters, we collect Account Information if or when you register. When you register and create an account as an Individual (an "Account"), we’ll ask you for information such as name, email and password.  When you register and create an account as a Venue on the Services (an "Account"), we’ll ask you for information such as your contact name, password, venue name, business address, email address, phone number, website address and if applicable, payment information (“Account Information”).  We use your email address to verify your Account (Venues only) and to communicate with you to verify information and approve your account.  Registered users or venues may access, add, remove or update certain information in their account settings or user profile, and it is your responsibility to keep all information in your account settings and user profile accurate and up to date. We may use Account Information, alone or together with other information, to enhance and improve the Services, such as by personalization based on Site browsing history and any other factors that will help make the experience better.

What happens when you visit the site?

Like most sites, our systems may record certain information about how users access and use the Services. The primary purpose for capturing log data is to use this information to administer the Services offered on the Site and to personalize, customize, measure and improve services when possible for you and other users.  For example, we may record things like your Internet Protocol (IP) address, Internet browser and operating system used to access the Services, device and application identifiers, access times and dates, referring and exit pages, click-stream data, pages viewed, time spent on pages, search terms, transaction information, location, bounce rate and login frequency.

What are Cookies?

Cookies are text files that may be sent to and saved by your web browser when you access a website; your web browser stores these cookies in a way associated with each website you visit, and you can generally see your cookies through your browser settings, depending on what browser you’re using. We use cookies and/or web tags to enable our servers to recognize your web browser and tell us how and when you use the Services. Our cookies do not, by themselves, contain information that personally identifies you, and we don't combine the general information collected through cookies with other such information to tell us who you are. However, we do use cookies to identify that you have logged in, and that your web browser has accessed the Services, and we may associate that information with your Account if you have one.  Most browsers have an option to disable cookies. 

However, disabling cookies may limit our ability to provide you with certain features of the Services. Also, some services that we may use (including Third Party Services) such as, but not limited to, Google Analytics use web tags and may also place their own cookies on your browser.  This Privacy Policy applies only to our own use of cookies and not to the use of cookies by any third parties. 

What happens when I use the site from my mobile device?

Anyone will be able to access the Site through either a native app (if available) or mobile web browser and use any applicable Services when connected through your mobile device.  When you download or use our applications or otherwise access the Services from a mobile device, we may receive information about your location and mobile device, including a unique identifier for your device which may be used to customize the Services for your location. Most mobile devices enable you to control or disable location services in the device’s settings menu, and your choices for location services may vary depending on the mobile device that you use to access the Services.

When a Venue publishes content to the Site (User Content):

By default, all content published through the Services is public, and when an approved venue provides us with content, they have sole control as to if or when to publish that content so that anyone can view it.  Once published, you should assume that it is publicly accessible.  All users should be considerate of others when posting information on the Services.  In addition, the Services may include features that enable users to “follow” approved venues in order to view the User Content and other Content that they post or share through the Services. To facilitate interaction on the Services, users may be notified of which other users have followed them.  More details about User Content can be found in our Terms of Service.

Will we email you?  Yes, but…

Email is a wonderful business tool when used properly and Artwell Guide strives to find that proper balance of keeping registered Users and Venues informed, not annoyed.  That said, we will inevitably email you or otherwise contact you to provide you with individual support to communicate with you about your account, products or services, or to provide you with general information about the Services, for example, to inform you about new features or other updates to the Services. If you do not wish to receive promotional communications from us, you may indicate this preference by following the instructions in our emails. However, we may still send you non-promotional communications such as those regarding your inquiries or paid subscriptions (Venues only), your relationship with Artwell, or updates to the Services or our general policies.

Other websites and third party services:

Over the course of offering the Services, we may provide links and features that enable you to access other websites or services that are not owned or controlled by us. We are not responsible for the privacy practices of any other websites or services, and we encourage you to read the privacy policies of any other websites or services that you access. If you login to Artwell through another social networking service, we may record your username on that service and other information that you make publicly accessible through that service, which may vary depending on your privacy settings on that service.   We may have third party companies or individuals provide services on our behalf related to the Services, including but not limited to maintenance services, email administration, web and data analytics, and database hosting. Unless we indicate otherwise, these third party service providers are permitted to use your Personal Information only as applicable to perform their services on our behalf.  Please note that this Privacy Policy does not apply to the privacy practices of any entities that we do not own or control, or to any people that we do not employ or manage.

Payment Information:

We will sometimes collect financial information, such as information related to your payment method (valid credit card number, type, expiration date or other financial information). This happens when you decide to purchase a paid Service. We do not, however, store that financial information; such information is stored by our payment processor Stripe (the "Payment Processor"), and use and storage of that information is governed by the Payment Processor’s applicable terms of service and privacy policy (the Payment Processor may also have other terms, and you are responsible for locating and familiarizing yourself with those terms, as applicable). We do receive certain information from our Payment Processor: (1) a unique token that we connect with your Account to enable you to make further purchases using the information stored by our Payment Processor and (2) in certain cases, the last four digits of the credit card number associated with that token, so that we can prevent fraudulent transactions and identity theft.  Any credit card information entered on the Services will be encrypted using Secure Socket Layer (SSL) technology for your protection.

The Security of your Information:

The Account Information for both Users and Venues is protected by a password for your privacy and security. We urge you to use a strong password containing unique numbers, letters and special characters, and to protect the confidentiality of your password at all times.  We may enable additional security features in the future, like multi-factor authentication.  It is your responsibility to prevent unauthorized access to your Account and information by creating a unique, secure, and protected password and limiting access to your computer and browser by signing off after you have finished accessing your Account on the Services.  We seek to protect your information (including your Account Information) to ensure that it is kept private; however, we can't guarantee the security of any information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of user information at any time.

Legal Purposes:

We may access, preserve and disclose any Personal Information or other user information if we believe that access, use, preservation and disclosure of such information is reasonably necessary to: (i) comply with any law, regulation, legal process or government request; (ii) enforce our Terms of Use or any other Artwell agreements or policies, or investigate potential violations; (iii) detect, prevent or otherwise address fraud, security or technical issues; or (iv) protect against harm to the rights, property or safety of Artwell, you or any other person or entity.

Changes to our Privacy Policy:

Artwell Guide reserves the right change, modify, or revise our Privacy Policy over the course of offering our Services, so please review it periodically. Unless we notify you otherwise, the most current version of this Privacy Policy will apply to any information that we have about you and your account. We may notify you of changes to this Privacy Policy by email and/or by posting the updated version of this Privacy Policy on the Services. Your continued use of the Services after any changes to this Privacy Policy become effective will constitute your acceptance of the updated Privacy Policy.
